Respecting Human Rights and the Rule of Law in Cyberspace: The challenges posed by trans-border access to data in criminal cases
Start date: 1 January 2018
This project focuses on how the nature and extent of criminal activity in cyberspace and the low levels of successful criminal prosecutions pose stark questions for respect for the rule of law in this new frontier as well as the human rights of victims. The project will explore the multifaceted nature of the human rights challenges in terms of the state’s obligations to respect human rights in accessing the data and to protect human rights. The objective is to formulate an overarching conceptual and policy framework that can assist in addressing the challenges encountered in this area.
This project is supported by QinetiQ Group plc. The supervisory team will include Dr Helen Quane (Swansea), Dr Patrick Bishop (Swansea), and Professor Stuart Macdonald (Swansea).
The successful candidate will have the opportunity to participate in activities organised by Swansea University’s Cyberterrorism Project (www.cyberterrorism-project.org).
